How can an estate plan prevent a guardianship proceeding?

Under our current set of laws, no one automatically has the right to make legal or medical decisions about another individual, or to get information about them simply because they're related to them. That permission has to come from one of two places. Either through planning or through the probate court. When we do estate planning, we provide an operations manual, a bag of tools, and name the individuals who should be in place to help. That process is used to avoid the necessity of going to court to get a guardianship.
